You can absolutely own a color scheme.

Trademarking a color allows a company to use a particular combination and shade of color in its own industry. McDonald's doesn't own the colors yellow red and white until you try to make a competitive burger chain against them.

Seems pretty ridiculous.

From my understanding they could probably hit you with a trademark infringement for that..

"a plaintiff must prove that it owns a valid mark, that it has priority (its rights in the mark(s) are "senior" to the defendant's), and that the defendant's mark is likely to cause confusion in the minds of consumers about the source or sponsorship of the goods or services offered under the parties' marks."

If you flipped the M and made it "wcdonald's" with everything else the same you would have a better case of being free do do it. After all you can't own a color scheme, and that's the main thing that catches your eye in that logo and name.

And yes, BladeWoods, anyone free to make their own separate multiplayer service under a different name and with different artwork and audio.  I suppose they could still use my client and server code to make this happen, but the result would not be commercially confusing (because people mostly recognize video games by their titles, graphics, and sound, not the underlying code).  Still, they would have a "leg up" on me, because the client and server code was very hard to write.  (Though DualDecade apparently didn't use any of the client code.)

My understanding is that I can't trademark "gameplay," so the only way to prevent code-identical clones would be through copyright on the code, and I don't want to do that.

As long as the codes stay free like you stated, I'm all for this. It can be a great starting platform for someone and its a great contribution to everyone. A great tool for the world to have.

Might disagree a tad bit with your stance on 2HOL, but i see where your coming from.

This all kinda reminds me of the stratocaster guitar. There are all kinds of different people and companies that can use the body platform and make their own versions of it, but as long as they don't try and take the trademarked names "strat" or "stratocaster" they can produce it without Fender guitars. It ultimately became the most emulated guitar body and at the same time the most popular guitar you see today.

Is it right that most of those people got somewhat of a free ride by using that body style for recognition? No probably not.. but at the end of the day they used it because it was a great platform that worked.. and now that guitar is the one drawn when you ask a child to draw a guitar. It became culture, or turned into a thing humanity as a whole kinda steals from haha.

#604 Re: Main Forum » JASON! You need to fix the area ban! » 2019-03-10 17:43:48

I think setting it at 1000 rather than 2000 would be a quick easy fix to this right? At least for now.

The eve system has definitely taken a slight hit from this. Ive seen a couple eve camps die gen 2 or 3 because they probably happened to be in the vicinity of a 2k ban from a town and just didn't get ANY births.

1k seems like a better solution. A viable eve spot might be 500 tiles from another one, so you could even make an argument for it being set at 500 with the only drawback being ground iron competition between eve camps. But the ground iron competition already happens (pretty minutely) with the eve spiral points being 250 tiles diagonally from each other.

I hear you on Trademark, but so many of the elements of the work would have to be brought to bear as part of the trademark---it would really have a chilling effect on any and all derivative works.  I mean, is the milkweed plant trademarked?  Could it be used in someone's logo or icon?  If so, would that imply my involvement?

If I was going to do that, I might as well use copyright.

It is a quandary, alright.

Absent copyright, which you don't want to use for well-established reasons, or trademark, which you might be reluctant to use for the same reasons, your position with Christoffer and his team seems to come down to goodwill and moral suasion.

I hope you can all come to a resolution that satisfies everyone, and I wish you all maximum clarity of everyone's desires and constraints in the discussions, whether public or private.

I see both sides to this argument and where you both are coming from. This really is a tricky situation.

I do feel like jason is in the right with his name needing to be branded as to not have this issue, and have his creation remain in name. Adding unofficial mobile version would greatly help all of this. Unless your consumers ONLY way of searching the internet is through the app store, (which I dont think would ever be possible) a quick search on a search engine will reveal the original source, jason.. Unless Chinese search engines would only find you website? Which I dont think would be possible.

Adding unofficial could also help you out if someone ever wanted to come after you, saying that you mislead them to having access to Jason's game. I dont think it would hurt you to do, because people can easily find out that there is no official mobile version of this game, and choose to buy your version that is.

1. Trees can block movement.  So, theoretically a village could get trapped by trees if all the axes OR shovels, and iron, also got moved outside of the village (or put inside of a room that no one can get into).  Junipers don't differ from other trees in this respect though, so this change doesn't make griefing more easy via that method

People didn't even go through with snowball walling off a city before and most walled cities didn't ever get finished. The only time walled cities occurred is when someone really cared to do it so you have a lot of faith trolls are going to waste their whole lives to put up a bunch of trees (which can be cut down and the stumps dug). Seems like you're worrying about something super silly.

2. Trees that don't get rewatered are useless.  So, shears, soil, and water can get wasted by tree planting.  Junipers again don't differ from other trees in that respect, so again I don't think this change affects griefing potential.

Who is even doing this? Most trees that don't get watered are by some old person who waters trees too late in their life to be able to tend to them the second time needed. That's just someone being too slow to fix up the kindling farm since you can't trust people to not chop down the trees for firewood as soon as you have to walk 10 tiles away for firewood.

3. Junipers don't yield butt logs, while most other types do.  This change does affect things with respect to griefing then.  Theoretically one person can plant massive juniper fields.  Then someone else can go along and hack up all of the junipers.  Since the amount of firewood among chopped trees is the same for trees that yield firewood (unless I've misunderstood this part about trees), massive juniper fields for tree cutting thus will yield fewer resources than say massive pine fields.  Thus massive juniper fields could be less efficient than massive fields of other tree types.

Buildings aren't very useful, so that means flooring is also generally not useful. Sure you need some level of butt logs for carts/boxes but that generally isn't an issue a village has. You generally get to a place where people will start cutting branch trees for firewood instead of taking a cart and hitting up the preferred firewood trees (pine, dead, swamp.) At best you would know this is a firewood farm unlike kindling farms which get axed because people are lazy.

3. comes as the problem I had in mind.  When I think about, I doubt it would be game-breaking, and many other griefer's tactics probably come as a lot worse.  So, I've probably worried about something rather inconsequential.  But, still, at the very least, massive juniper fields for tree cutting aren't as good as other fields of trees for tree cutting.

Trolls and griefers are lazy. There are much easier and more efficient griefs in game than just planting a bunch of random trees and caring for them.

Agreed, the juniper fields would be a delightful grief in my eyes. The best fix for greifers with these fixes wasn't even the snow balls or snowman changes, but the salt water bucket being labeled. The best grief I still have ever seen was when someone filled all the buckets with salt water right as all of the food cycle needed water the most and nobody noticed until ot was way too late. I was afraid to even talk about it, for fearing that people would do it.

Gotta keep in mind that, just like we would be able to wear armor to protect ourselves from griefers, the griefers could wear armor to protect themselves from us. Not saying that armor shouldn't be added eventually, but just wondering how it would work.

I was thinking that, instead of stopping you from being wounded, it could increase the time you have before dying, so you have more time to reach the town if you get wounded in the wilderness and people have more time to heal you. Then if a griefer gets their grubby hands on some armor, they don't become impossible to kill, because armor won't, by itself, stop people from getting wounded and dying. Then, the better the armor, the more seconds you have before dying.

If there were two types of armor it could be done. Both weapons already lie around in the open too often now anways.

One stab proof (chainmail maybe)

One arrow proof (maybe some kind of plate armor?)

*Bonus armored boots. (No snake bites)

If the translation actually is one hour life in Chinese, would you feel better if they called it "One hour life" in English instead?

I can understand the naming confusion being an issue like you stated, with people not knowing you have no part in dual decade or vice versa. With them adding things not from you, it only compounds the problem because now its not just a direct port that carries your original vision anymore.

It sounds like a name change by dual decade would solve all these issues right? It wouldn't confuse anyone anymore.

While it sucks that they are changing the game, there was a spillage of players that did buy the game from you because of the mobile version. So I think developing a symbiotic relationship, like you have with things like this, is better than going to war with it.

Agreed. Probably a lot more doodling than we can imagine before the final product. I often doodle the faces at work from memory and can get some of them sorta right, but I always struggle with the bodies of the characters. I can draw berry bushes from memory pretty well though from seeing them so much tongue

One of my favorite doodles recently came after some character sketch attempts and i want to eventually tidy it up and have its head be my forum avatar. I'm going to get some uniball pens and do the same type of line work and layering Jason does to get the same type of effect.. Eventually though.. I still have other art project supplies that demand the money first. Wood polyurethane aint cheap yikes

But I do have the photo editing software and know-how..

futureavatar.jpg

Rough sketch.. Even rougher because it was in my back pocket for day or two and was done on very tricky paper to write on (very thin) But the final picture will have him wearing fruit boots as well. My two favorite things in this game, the shrooms and the boots!

I had an idea kinda similar but more of a /elder entry that gives whoever recieved more than 4 elders an extra 10 minutes. I don't think it could ever be possible though.

"Builds diesel engine to perfection.. Cant make a goose down jacket and not be cold."

I have hope its coming next though. These updates with fixes this week are actually pretty good game changers too! I pretty much support everything being done with this update.

My last vegetable child scared the crap out of me more than anything in this game so far. She was my last child and the only girl left, so I made sure to throw her in the perfect spot and feed her. She stayed in that spot and had her first child. As i was raising her first son and explaining that his mom was braindead, she snapped out of her coma and starts running. I immediately had to chase her down and beg her not to die since I spent 15 minutes plus keeping her alive. Somehow she didn't die though, and the line kept going.

The grim: Address the concerns of the village when young, but tend to work on more personal projects as you grow old. Half of the time you go senile in the last part of life, and end up dancing for the childrens, hiding behind a tree saying "I'm a tree!", or writing notes.

Also devote too much attention to cactus worship, and make more fruit boots than you probably should.

Not actually shorter, but i added "freely available" to embed the meaning of public domain.  The part in brackets would be updated for the precise name of the game.

I think this one looks like a winner.
